Términos y condiciones
v1.1 update: in v1.0 the sign-up checkbox only explicitly referenced the privacy policy; the "terms and conditions" strings existed translated but were not wired to any real checkbox. This work has confirmed this is already fixed (
login_register.twig, issue #173): the registration checkbox now accepts both documents. SeeTEXTOS_CASILLAS.md.
Scope of this document
These are the only terms and conditions of the VoiceScan platform
(app.voicescanlab.com). The public website voicescanlab.com does not
need its own purchase terms and conditions because it does not sell
anything directly; it is governed by AVISO_LEGAL_EN.md.
1. Purpose
These terms govern the use of the VoiceScan platform (app.voicescanlab.com), an acoustic analysis service for sung voice for educational purposes, provided by Voice Scan Lab, S.L.
VoiceScan is not a medical service. The report you receive describes vocal mechanics parameters and offers singing technique recommendations; it is not a diagnosis and does not replace any healthcare professional.
2. User accounts
- To use the platform with an account, you must provide truthful data (first and last name, email) and keep your password secret.
- You are responsible for the activity carried out from your account.
- If you are under 14, you need the authorisation of your parent or legal
guardian to create an account (see
PRIVACY_POLICY_EN.md§9). - You can deregister at any time from your profile or by writing to us.
3. Service profiles
- Anonymous guest: can try an analysis without creating an account, from the free landing page. The result is shown in summarised form (a "hook report"). They can claim that analysis later if they create an account.
- Student: has access to one free full welcome analysis and, afterwards, to sample reports until the purchase of full analyses is available.
- Teacher / school: manages their students, sessions, recordings and
analyses, within their teaching relationship with them (see
PRIVACY_POLICY_EN.md§8).
4. Sample reports and full analyses
The platform currently offers one free full welcome analysis and, after that, sample reports. The purchase of additional full analyses is planned ("coming soon") and is not active as of the date of this document. Once it is activated:
- the price and purchase conditions will be shown in the payment flow itself, not in this document;
- payments will be processed through Stripe as the payment gateway;
- since it is digital content that is executed or made available to you
immediately after purchase, you will lose your right of withdrawal
at the moment the full analysis is delivered to you, under article
103.m of the Spanish Consolidated Text of the General Law for the
Defence of Consumers and Users (TRLGDCU). This requires three
cumulative conditions, all three of which must actually be met in the
purchase flow, not assumed:
- that you expressly accept, before paying, that the analysis will start being executed immediately (not after the 14-day withdrawal period ends);
- that you expressly acknowledge, in that same step, that you therefore lose your right of withdrawal; and
- that we send you a confirmation on a durable medium (for example, email) recording both of the above. Without all three, the right of withdrawal remains even if the analysis has already been delivered. We will tell you this clearly in the payment flow itself, not as a footnote, and we will keep the email confirmation as proof that the three conditions were met.
- if the analysis fails to run (for example, due to a system error), you keep your right to a refund.
This document does not set prices: prices are communicated in the purchase flow itself once it is active.
5. Acceptable use
You may not use the platform to:
- upload voice recordings of third parties without their consent (or, if they are under 14, without their parent's or guardian's consent);
- attempt to identify or re-identify other people from anonymised service data;
- reverse-engineer the analysis engine or the machine learning models;
- carry out any use that infringes third-party rights or applicable law.
6. Intellectual property
The software, the analysis engine, the machine learning models and the
VoiceScan methodology are the property of Voice Scan Lab, S.L. The report
generated for your own recording is yours for your personal and
educational use, under the terms of AVISO_LEGAL_EN.md §5.
7. Service availability
We make reasonable efforts to keep the platform available, but we do not guarantee uninterrupted operation. We may temporarily suspend the service for maintenance, and we will notify you when this is foreseeable.
8. Limitation of liability
Voice Scan Lab, S.L. is not liable for decisions that you or a third party
make based solely on the generated report, without contrasting it with
the judgement of a voice professional. The report is a support tool,
generated by an artificial intelligence system (see PRIVACY_POLICY_EN.md
§5), not an infallible assessment.
9. Changes to these terms
We may update these terms to adapt them to regulatory or service changes. If the change substantially affects conditions you already accepted, we will notify you and, if applicable, ask you to accept them again before continuing to use the service.
10. Account closure and termination
You can request the closure and complete deletion of your account at any
time (see PRIVACY_POLICY_EN.md §10). Voice Scan Lab, S.L. may suspend or
cancel an account that breaches point 5 of these terms, with prior notice
unless the severity of the breach prevents it.
11. Applicable law and complaints
These terms are governed by Spanish law. If you are a consumer, you can go to the courts of your own domicile. If you have a complaint about the service, write to us first at legal@voicescanlab.com; if you remain unsatisfied, you can go to the relevant complaint forms or to the European online dispute resolution platform where it applies to an active purchase.
